Defendants charged with conspiracy to possess with intent to
distribute marijuana and possession of marijuana moved to dismiss charges
against them on double jeopardy grounds. The District Court, Saffels, Senior
District Judge, held that: (1) conspiracy to possess with intent to distribute
charge was so interdependent with conspiracy to possess with intent to
distribute charge ultimately dismissed in Florida as to constitute one
conspiracy, and (2) marijuana which formed basis of possession charge was not included
in calculation of defendant's Florida sentence.
Motions denied.
