On variety of motions by defendants charged with drug offenses and/or perjury,
the District Court, Crow, J., held that: (1) there was no staleness precluding
existence of probable cause for search warrant; (2) inclusion or deletion of
information from search warrant affidavit would not have vitiated other facts
supporting probable cause; (3) indictment adequately apprised defendants of
various crimes charged; (4) witness' testimony before grand jury was not
coerced; (5) there was no violation of defendant's Sixth Amendment rights when
deputy went to house of defendant's parents, where defendant was living; and
(6) methamphetamine cookbook was obtained pursuant to valid third party
consent.
Ordered accordingly.
