Defendants were indicted for conspiring and attempting to
manufacture methamphetamine as well as various firearms violations. Defendants
moved to suppress evidence. The District Court, Crow, Senior District Judge,
held that: (1) initial traffic stop of defendant was lawful; (2) defendant's
consent to search his truck was voluntary; (3) officer was justified in
conducting Terry pat down search of defendant for weapons; (4) officer
had probable cause to arrest defendant; (5) exigent circumstances justified police
officers' warrantless entry into defendant's trailer; and, on motion for
reconsideration, (6) defendant was not entitled to severance.
Motions denied.
