Defendant who was convicted of armed bank robbery, use of a firearm in relation to crime of violence, and conspiracy to commit bank robbery filed objections to presentence report, and moved for downward departure. The District Court, Rogers, Senior District Judge, held that: (1) defendant had not accepted responsibility for his actions, and was not entitled to reduction in offense level under Sentencing Guidelines on that basis, and (2) defendant was not entitled to downward departure.
So ordered.
