Following indictment for drug conspiracy and
firearms-related offenses, defendants and government filed various pretrial
motions. The District Court, Crow, J., held that: (1) defendants were not
entitled to exclusion from evidence of information government intended to
introduce through testimony of its informant, despite contention that
government impermissibly delayed providing defendants with such information
until after filing of defendants' pretrial motions; (2) local rule, requiring
that master wheel for grand jury selection be emptied and refilled between
January 1 and June 30 of year following year in which presidential election is
held, was not violated; and (3) possibility that defendants might be convicted
of conspiracy under aiding and abetting theory or Pinkerton theory did
not preclude defendants from introducing evidence tending to demonstrate they
were not physically present at time crime was committed.
Defendants' motions denied.
