Defendants were charged with various drug and weapons
violations. Following guilty pleas, defendants moved to compel performance of
plea agreements or to withdraw guilty pleas. The District Court, Crow, J., held
that: (1) fact that defendants "passed" polygraph examinations did
not automatically entitle them to governmental motion to reduce sentences for
substantial assistance; (2) Government did not act in bad faith by failing to
move for reduction in sentences; but (3) defendants were entitled to withdraw
guilty pleas.
Motions denied in part and granted in part.
